Regulations on the Emblem and Flag of the Communist Party of China

Article 1 To regulate the production, use, and management of the Party emblem and Party flag, fully exert their political functions, enhance the Party's cohesion and combat effectiveness, stimulate Party members' awareness of the Party, inspire the entire Party to remain true to the original aspiration and keep the mission firmly in mind, strengthen ideals and beliefs, and unite and lead the people of all ethnic groups across the country to forge ahead under the Party's banner, these regulations are formulated in accordance with the Constitution of the Communist Party of China.
Article 2 The Party emblem of the Communist Party of China consists of a pattern of a sickle and hammer. The Party flag of the Communist Party of China is a red flag with a golden Party emblem pattern on the flag surface.
The Party emblem and Party flag indicate that the Communist Party of China is the vanguard of the Chinese working class, as well as the vanguard of the Chinese people and the Chinese nation. It is a Marxist party that tirelessly strives for the happiness of the Chinese people, the rejuvenation of the Chinese nation, the adherence to and development of socialism with Chinese characteristics, and the realization of the great ideal of communism.
Article 3 The Party emblem and Party flag of the Communist Party of China are the symbols and signs of the Communist Party of China.
All levels of Party organizations and every Party member must safeguard the dignity of the Party emblem and Party flag.
Article 4 The production, use, and management of the Party emblem and Party flag must adhere to unified standards and unified norms, and follow the principles of hierarchical responsibility and centralized management.
Article 5 The general diameters of the Party emblem are the following three sizes:
(1) 100 centimeters;
(2) 80 centimeters;
(3) 60 centimeters.
When it is necessary to hang a Party emblem of a non-general size, it should be proportionally enlarged or reduced according to the general size to suit the hanging background and occasion.
The Party emblem pattern generally uses golden yellow or red.
Article 6 The following situations should use the Party emblem or Party emblem pattern:
(1) When holding the Party's National Congress, representative meetings, and local representative congresses and meetings, hang the Party emblem in a prominent position, with five red flags on each side of the Party emblem;
(2) When holding plenary meetings of the Party's central and local committees, hang the Party emblem in a prominent position;
(3) The seals (impressions) of the Party's central and local committees and their working departments, the representative organs dispatched by the Party's central and local committees in specific regions and their working departments, the Party's disciplinary inspection organs, Party groups, and grassroots Party organizations shall have the Party emblem pattern engraved in the center.
Article 7 The Party's grassroots committees may hang the Party emblem when holding Party member meetings or Party member representative meetings as needed.
The following situations may use the Party emblem pattern:
(1) Certificates, signs, etc., used in important Party meetings and activities;
(2) Medals, badges, certificates of merit, certificates, and other honorary documents and certificates issued by Party organizations at all levels, as well as related work certificates produced;
(3) Important Party publications and propaganda materials;
(4) Websites of Party organizations at all levels;
(5) Party member education bases, Party member vanguard posts, Party building bulletin boards (walls), as well as grassroots Party organization activity venues such as Party-mass service centers and Party member activity rooms;
(6) Conducting the Party's external exchange activities.
Article 8 The general sizes of the Party flag are the following five types:
(1) Length 288 centimeters, width 192 centimeters;
(2) Length 240 centimeters, width 160 centimeters;
(3) Length 192 centimeters, width 128 centimeters;
(4) Length 144 centimeters, width 96 centimeters;
(5) Length 96 centimeters, width 64 centimeters.
When it is necessary to use a Party flag of a non-general size on specific occasions, it should be proportionally enlarged or reduced according to the general size.
Article 9 The following situations should use the Party flag:
(1) Holding the oath-taking ceremony for new Party members and organizing Party members to review the Party oath;
(2) Major celebrations and commemorative activities within the Party;
(3) Meeting rooms of the Party's central and local committees and their working departments, representative organs dispatched by the Party's central and local committees in specific regions and their working departments, and the Party's disciplinary inspection organs and Party groups.
Article 10 The following situations may use the Party flag:
(1) Holding Party member meetings and grassroots Party representative meetings;
(2) Grassroots Party organizations carrying out theme Party days;
(3) Party member education bases, Party member vanguard posts, as well as grassroots Party organization activity venues such as Party-mass service centers and Party member activity rooms;
(4) Party organization positions, Party member commando teams, etc., at the front line of important work, key project breakthroughs, emergency rescue, disaster relief, and epidemic prevention and control;
(5) Conducting the Party's external exchange activities.
Except for the above situations, the use of the Party flag pattern generally refers to the situations where the Party emblem pattern can be used.
Article 11 When special circumstances require the simultaneous hanging of the Party flag and other flags, the Party flag shall be placed in the primary position.
Article 12 The production of Party emblems and Party flags of non-general sizes, and the use of Party emblems, Party flags, and their patterns outside the prescribed situations, shall be approved by the Party organization department at or above the county level.
Article 13 The Party emblem, Party flag, and their patterns shall not be used for:
(1) Trademarks, patented design appearances, and commercial advertisements;
(2) Private activities;
(3) Identification marks in private places and personal online spaces;
(4) Personal daily necessities and daily life decorations;
(5) Other inappropriate places, situations, and environments.
Article 14: No text, symbols, patterns, etc. shall be added to the Party emblem and Party flag. Damaged, soiled, or faded Party emblems and Party flags shall not be used. The production and use of any Party emblem and Party flag that do not comply with the attached production instructions of these regulations are prohibited. The Party emblem and Party flag shall not be hung upside down, inserted upside down, or used in any other manner that damages their dignity.
The Party emblem and Party flag shall not be discarded arbitrarily. Party emblems and Party flags that are damaged, soiled, faded, or marked with text and symbols that do not meet production and usage regulations shall be recovered and disposed of according to regulations. After major celebrations or commemorative activities within the Party, the Party emblems and Party flags used at the event shall be recovered or properly disposed of by the relevant units based on the principle of 'who issues, who is responsible'.
Article 15: After a Party member passes away, with the consent of the grassroots Party committee with relevant approval authority at the unit where the Party member's organizational relationship is located, the Party flag may be draped over the body or urn. However, the Party flag must not touch the ground, be cremated with the body, or be buried with the urn.
Article 16: When using the Party emblem and Party flag patterns on the internet, publications, etc., they shall be placed in prominent positions.
The standard versions of the Party emblem and Party flag patterns used on the internet, publications, etc., are published on the Communist Party Member Network and the Chinese Communist Party News Network.
Article 17: Knowledge of the Party emblem and Party flag shall be an important part of Party history education, Party member training, and training for Party activists.
Party organizations at all levels shall educate Party members, Communist Youth League members, Young Pioneers, and the public to understand the history and spiritual connotations of the Party emblem and Party flag, consciously standardize the use of the Party emblem and Party flag and their patterns, and respect and cherish the Party emblem and Party flag.
All news and publishing units shall strengthen the publicity of knowledge about the Party emblem and Party flag, report and use news and images containing standardized Party emblem and Party flag patterns, and safeguard the Party's image.
Article 18: The Party emblem and Party flag shall be produced in accordance with the attached production instructions of the Chinese Communist Party emblem and Party flag in these regulations. Production enterprises shall be designated by the Organization Department of the provincial (autonomous region, municipality) Party committee among enterprises with production qualifications. No unit or individual shall produce the Party emblem and Party flag without approval.
Article 19: In principle, the Party emblem and Party flag shall be centrally allocated and distributed, ensuring that each Party committee has one Party emblem and each branch has one Party flag. The required funds may be allocated from Party dues.
Article 20: Party organizations at all levels shall regard maintaining the dignity of the Party emblem and Party flag as a political task and earnestly fulfill their main responsibilities. The organization departments of Party committees at or above the county level shall perform supervisory and management responsibilities for the Party emblem and Party flag work in their regions, units, and systems, and jointly strengthen supervision and management of the production, sale, and commercial use of the Party emblem and Party flag with market supervision departments.
Enterprises and individuals illegally producing or selling Party emblem and Party flag products, and those violating the use of the Party emblem and Party flag and their patterns in these regulations, shall be subject to criticism and education and timely correction. In serious cases or if corrections are refused, they shall be dealt with according to relevant regulations, and those suspected of illegal crimes shall be handled according to law.
Article 21: The Central Military Commission may formulate relevant regulations in accordance with these regulations.
Article 22: The Party member badge is an identity mark of Party members, and its production, use, and management are separately regulated.
Article 23: These regulations shall be interpreted by the Central Organization Department.
Article 24: These regulations shall come into effect from the date of promulgation. Any previously issued regulations concerning the Party emblem and Party flag that are inconsistent with these regulations shall be implemented in accordance with these regulations.
